HARASSING COMMUNICATION, THREATS

Cornwall, ON – A 14-year-old Cornwall youth was arrested on April 8th, 2020 and charged with harassing communication and threats. It is alleged during the month of April 2020, the man repeatedly communicated with his ex-girlfriend despite being warned not to and made threats to harm her. Police were contacted and an investigation ensued. On April 8th, 2020 the youth attended police headquarters to deal with the matter. He was taken into custody, charged accordingly and released to appear in court at a later date. His name was not released as per provision of the Youth Criminal Justice Act.

THEFT UNDER$5000, FRAUD, UNAUTHORIZED USE OF A CREDIT CARD

Cornwall, ON – Frank Benedict, 37 of Cornwall was arrested on April 8th, 2020 and charged with theft under $5000, fraud under $5000 x2 and unauthorized use of a credit card x2. It is alleged during the months of January and February, 2020 the man used a stolen credit card to make purchases within the city of Cornwall. Police were contacted and an investigation ensued. The man was located on April 8th, 2020, taken into custody, charged accordingly and released to appear in court on June 25th, 2020.

There were 51 calls for service in the City of Cornwall in the last 24 hours (8am the previous day to 8am the day of the release).

OPP STREET CRIME UNIT SEIZES WEAPONS AND DRUGS IN HAWKESBURY

(HAWKESBURY, ON) – The Ontario Provincial Police (OPP) East Region Community Street Crime Unit (CSCU) has seized weapons and illegal drugs in Hawkesbury.

On April 9, 2020 members of the Street Crime Unit, OPP Tactics and Rescue Unit (TRU), OPP Emergency Response Team (ERT) and Hawkesbury OPP Detachment members executed a search warrant at a home on Main Street West.

Officers seized a quantity of suspected Methamphetamine and Percocet tablets, a quantity of suspected cocaine, a loaded rifle and magazine, an air soft rifle and over $2000 in Canadian currency.

Nathalie PLOUFFE, age 50 or Hawkesbury and Chavez DEGUIRE, age 21 of Grenville sur la Rouge, Quebec are each charged with:

  • Careless storage of a firearm – Criminal Code (CC) sec. 86(1) – two counts
  • Unauthorized possession of a firearm – CC sec. 91(1)
  • Possession of proceeds of property obtained by crime under $5000 – sec. 354(1)(a)
  • Possession of a Schedule 1 substance for the purpose of trafficking – Controlled Drugs and Substances Act (CDSA) – sec. 5(2) – two counts

The accused have been released and are scheduled to appear at the Ontario Court of Justice in L’Orignal on August 8, 2020.

(STORMONT DUNDAS & GLENGARRY, ON) – The SD&G Detachment of the Ontario Provincial Police (OPP) are investigating several incidents after responding to 340 calls for service from Monday April 6, 2020 to Tuesday April 14, 2020

Among these occurrences, SD&G OPP responded to:

DOMESTIC – MISCHIEF

(NORTH DUNDAS,ON) – On April 6, 2020 at approximately 8:06 a.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of domestic situation in North Dundas Township. Investigation revealed that an adult accused had caused damage to the residence and was breaching previous release conditions.

A 38-year-old accused of North Dundas, Ontario was arrested and is charged with;

– Mischief

– Fail to comply with conditions of a probation order

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Cornwall on June 23, 2020.

ASSAULT – DOMESTIC

(NORTH DUNDAS,ON) – On April 8, 2020 at approximately 8:00 a.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of domestic situation in North Dundas Township. Investigation revealed that an adult accused had assaulted the victim multiple times on this date and previous dates.

A 46-year-old accused of North Dundas, Ontario was arrested and is charged with;

– Assault

– Assault with a weapon

– Assault cause bodily harm- choke, strangle or suffocate ( two counts)

– Assault causing bodily harm

– Forcible confinement

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Cornwall on June 23, 2020.

BREAK IN

(SOUTH DUNDAS,ON) On April 8, 2020 at approximately 1:50 p.m Stormont, Dundas & Glengarry Ontario Provincial Police officers responded to a report of a break in at a residence County Road 11 in South Dundas Township. The same residence was broken into the week (April 4th 2020) before with unknown culprit(s) attending the residence and removing several tools and power tools. On this date nothing was taken. On April 13, 2020 the same residence had another attempted break in, with the culprit(s) unable to gain access.

An Investigation continues.

ASSAULT PEACE OFFICER

(NORTH GLENGARRY,ON) – On April 9, 2020 at approximately 7:20 p.m, Stormont, Dundas &Glengarry Ontario Provincial Police officers responded to a report of a suspicious person inside a business on County Road 20, North Glengarry Township. Investigation indicated that an unwanted adult was in the business being aggressive with staff. The adult was located a short distance away. Once in custody the accused assaulted an officer.

Melissa POWERS (33) from Smiths Falls, Ontario was arrested and is charged with;

– Assault a Peace officer

– Being intoxicated in a public place (Liquor Licence Act)

– Engage in prohibited activity on premises (Trespass to property Act)

The accused was released from custody pending a court appearance at the Ontario Court of Justice in Cornwall on June 25, 2020.

(SOUTH STORMONT,ON) – On April 9, 2020 at approximately 10:38 p.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of domestic situation in South Stormont Township. Investigation revealed that an adult accused had caused damage to the residence and was breaching previous release conditions.

A 37-year-old accused of South Stormont, Ontario was arrested and is charged with;

– Mischief

– Fail to comply with conditions of a probation order

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Cornwall on June 9, 2020.

ASSAULT – DOMESTIC

(NORTH DUNDAS,ON) – On April 10, 2020 at approximately 4:56 p.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of domestic situation in North Dundas Township. Investigation revealed that an adult accused had assaulted the victim.

A 37-year-old accused of North Dundas, Ontario was arrested and is charged with;

– Assault

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Cornwall on June 23, 2020.

STOLEN CAR

(NORTH DUNDAS,ON) – On April11, 2020 at approximately 3:50 p.m, Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) responded to a report of a theft of a car from a residence on Joseph Street in Chesterville, Ontario. Investigation indicated that sometime overnight April 11, 2020 a 2006 White Pontiac Grand Prix (plated- Ontario -CEZW 438) was removed from the property.

An investigation continues.

WEAPONS CHARGES LAID 

(SOUTH GLENGARRY,ON) – On April 12, 2020, at approximately 12:13 a.m Stormont, Dundas & Glengarry Ontario Provincial Police officers conducted a traffic stop on Highway 401 in South Glengarry Township.

SD&G OPP officers located the vehicle travelling at a high rate of speed (131km/hr in a posted 100km/hr zone). SD&G OPP officers intercepted the vehicle and arrested the male passenger as he was in breach of previous release conditions and the passenger was also in possession of pepper spray.

Reda KHADIR (19) of Montreal, Quebec was located and arrested and is charged with;

–             Fail to comply with conditions of a undertaking ( three counts)

–             Fail to comply with conditions of a probation order ( two counts)

–             Concealed prohibited device or ammunition

–             Possess of firearm or ammunition contrary to prohibition order

–             Knowledge of unauthorized possession of weapon

The 19 year -old driver of Montreal, Quebec was charged for speeding (Highway Traffic Act)

The accused was released from custody and is scheduled to a court appearance at the Ontario Court of Justice in Alexandria July 8, 2020.

STOLEN CAR

(SOUTH STORMONT,ON) – On April 13, 2020 at approximately 11:03 a.m, Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) responded to a report of a theft of a car from a residence on Beaver Dam Drive, South Stormont Township. Investigation indicated that sometime overnight April 12-13, 2020, a 2009 Dark blue Chevrolet Impala (plated- Ontario -CHFN 562) was removed from the property.

An investigation continues.

EXCESSIVE SPEEDS

(SD&G) – On April 9th to April 12th , 2020 Ontario Provincial Police officers conducted speed measuring enforcement in SD&G and intercepted the following vehicles for traveling at excessive speeds. The vehicles were impounded and their driver’s permits seized for seven (7) days in accordance to policy and were charged with Stunt Driving (Highway Traffic Act).

– April 9, 2020- 12:14 pm (South Glengarry) vehicle stopped traveling 160km/h (100km/h zone) (Highway 401) – 26-year-old driver from Waterloo Ontario.

– April 1, 2020- 6:36 am (South Dundas) vehicle stopped traveling 163km/h (100km/h zone) (Highway 401) – 24-year-old driver from North York, Ontario. The driver was also suspended.

– April 12, 2020- 7:13 am (South Glengarry) vehicle stopped traveling 160km/h (100km/h zone) (Highway 401) – 26-year-old driver from Quebec.

EOHU Failure Leads to Alleged Contamination of FOOD BASICS on Brookdale from Tim Horton’s COVID 19 Coronavirus Victim.

APRIL 19, 2020 – Social media is a blaze locally as a local Food Basics worker tested positive for COVID 19.

The EOHU refuses to answer any questions from this newspaper or issue us their press releases directly so we apologize as we can only get their version from their own press release once published.

2020-04-18

The Eastern Ontario Health Unit (EOHU) is notifying the public that a case of COVID-19 has been confirmed in an employee at the Food Basics grocery store on Brookdale Ave. in Cornwall. The EOHU is actively working in cooperation with the Brookdale Food Basics store to assess the risk to store employees and to trace contacts of the individual. The risk to the public is considered to be low.

The employee worked day shifts at the Brookdale Food Basics store on April 13th, 14th, 15th, 16th and 18th. The individual started to develop symptoms on April 15th and was tested for COVID-19 on April 17th; the result was confirmed on April 18th. After receiving the test result, the employee immediately left work and entered isolation. All recommended public health measures were in place at the store throughout the days that the employee worked. In response to the positive case, the store is undertaking appropriate additional cleaning and disinfection.

“Although we feel that the risk to the public is low, we’re releasing this information so that shoppers who were at the Brookdale Food Basics during this period are aware,” states Dr. Paul Roumeliotis, Medical Officer of Health. “As a precaution, shoppers who were at the store on these dates should self-monitor for symptoms. If they start to feel symptoms, they should seek testing.” Common symptoms of COVID-19 can include fever, a new or worsening cough, sore throat, muscle aches and more. 

When the Costco in Vaudreuil Dorion had a similar situation recently occur people were advised to self isolate for 14 days. This has not occurred nor has information about other Food Basics employees exposed at that time being told to stay home for two weeks.

Dr. Paul Roumeliotis again needs to be fired at this point as this is yet another example of his Units failure.

The release for example doesn’t state whether it was a cashier or floor worker, or management?

The release doesn’t state that testing of all staff possibly infected by this person has been initiated.

The location should be closed for deep cleaning by a 3rd party.

The party apparently came to work after being tested. Charges should be filed. If the store was aware they were tested why would the employee be allowed back?

It also really shows why at this point all employees should be masked up, and anyone that goes out should be masked up.

If the allegations are confirmed that the worker is in some fashion connected to the Tim Horton’s worker who tested positive recently why wouldn’t they have been tested immediately?

If connected to the Tim Horton’s case they would themselves have to isolate for 14 days, at least, if not longer until the worker tested negative. Again, this would be criminal behavior warranting charges be laid against the worker.

Lack of information, poor quality of information, and frankly putting the public at risk and we pay this fellow at the EOHU over $300K per year?

Food Basics is part of the Metro chain of fine grocers. This is from their website regarding cases like this:

We take the current situation very seriously. If an employee or a customer tests positive for COVID-19, we will follow the recommendations of health authorities and hire a specialized company to disinfect and clean the location in question. Please rest assured that we are taking all the necessary measures to ensure the safety of our employees and customers.

Again, it would be prudent to use best case practices in this situation, but if our Health Unit isn’t implementing them can you blame the store? It should be deep cleaned, all exposed staff sent home for 14 days, and all staff masked up while working.

BREACH

Cornwall, ON – A 17-year-old Cornwall youth was arrested on April 18th, 2020 and charged with breach of undertaking for breeching his curfew. It is alleged an officer conducted a compliance check on April 17th, 2020 and found the youth to be in breach of his conditions. The youth was located on April 18th, 2020, taken into custody, charged accordingly and held for a bail hearing. His name was not released as per the Youth Criminal Justice Act.

ONGOING INVESTIGATION RESULTS IN NUMEROUS CHARGES FOR CORNWALL MAN

Cornwall, ON – As a result of a joint effort by the Cornwall Police Service (CPS) Criminal Investigation Division and Community Patrol Division, an arrest has been made in relation to a series of criminal offences that had occurred in the months of March and April.

As a result of the investigation, Spencer Blanchette, 18, of Cornwall was arrested on April 18th, 2020 and charged with the following:

  • Break and enter x 3
  • Possession of break in instruments
  • Arson – Cause damage to property
  • Possession of a Schedule I substance – methamphetamine
  • Theft of motor vehicle
  • Occupant of motor vehicle taken without consent

It is alleged between March 6-7, 2020, the man entered an abandoned McConnell Avenue building and caused damage while inside. On March 27th, 2020, the man once again entered the building and was responsible for causing a fire, resulting in extensive damage to the building.

Further, between April 9-10, the man attended the Riverdale area, where he entered a resident’s garage without their permission and removed a bicycle. During the same period of time, the man took a motor vehicle that did not belong to him. A second motor vehicle was taken from the Riverdale area between April 9-10, in which the man was allegedly an occupant in the stolen vehicle. The investigation into the second stolen motor vehicle remains ongoing at this time.

During the early morning hours on April 18th, 2020, the man was located by police and was found in possession of various break-in instruments and a quantity of methamphetamine. He was charged accordingly and held for a bail hearing.

CONTROLLED SUBSTANCE

Cornwall, ON – Robert Lanoue, 47 of Cornwall was arrested on April 18th, 2020 and charged with the following:

• Individual to possess more than four cannabis plants that are not budding or flowering
• Possess cannabis for the purpose of distributing
• Individual who is 18 years of age or older to cultivate, propagate or harvest, or to offer to cultivate, propagate or harvest more than four cannabis plants at any one time in their dwelling-house
• Possess a Scheduled II substance – hashish
It is alleged police were called to a fire scene on April 13th, 2020 and discovered the man was in possession of more than his legal limit of marijuana plants and an investigation ensued. He was taken into custody on April 18th, 2020, charged accordingly and released to appear in court at a later date.

MISCHIEF

Cornwall, ON – A 40-year-old Cornwall woman was arrested on April 19th, 2020 and charged with mischief. It is alleged during an argument on April 19th, 2020 the woman damaged her ex-boyfriend’s door and police were contacted to investigate. She was taken into custody during the investigation, charged accordingly and released to appear in court on July 7th, 2020. Her name was not released as it would identify the victim in the matter.

ASSAULT

Cornwall, ON – A 31-year-old Cornwall man was arrested on April 19th, 2020 and charged with assault. It is alleged during an argument on April 19th, 2020 the man assaulted his ex- common-law wife and police were contacted to investigate. He was taken into custody during the investigation, charged accordingly and released to appear in court on July 7th, 2020. His name was not released as it would identify the victim in the matter.

BREACH, ASSAULT POLICE, RESIST ARREST

Cornwall, ON – Stephen Donnelly, 20 of Cornwall was arrested on April 19th, 2020 and charged with breach of recognizance for being in possession of a weapon (knife), assault police and resist arrest. It alleged on April 19th, 2020 while investigating a disturbance at a Guy Street residence police found the man in breach of his conditions for having been in possession of a knife. While attempting to place the man under arrest he assaulted an officer and he was taken into custody after a brief struggle. He was charged accordingly and held for a bail hearing.

BREACH

Cornwall, ON – A 36-year-old Monkland man was arrested on April 19th, 2020 on the strength of a warrant. It’s alleged in March, 2020 the man breached his conditions by attending his ex-common-laws residence, despite his conditions. He also failed to report a change of address to police and was no longer residing with his surety. Police were contacted and a warrant was issued for his arrest. He was located on April 19th, 2020, taken into custody on the strength of the warrant and held for a bail hearing. His name was not released as it would identify the victim in the matter.

BREAK AND ENTER, ASSAULT WITH A WEAPON, POSSESSION OF A WEAPON FOR A DANGEROUS PURPOSE, BREACHES

Cornwall, ON – Mohammed Chughtai, 24, Johnathan Gauthier, 20 both of Cornwall and Johnathan Carriere, 23 of Martintown were arrested on April 19th, 2020 and charged as follows:
Mohammed Chughtai :
• break and enter, commit indictable offence
• assault with a weapon
• weapons dangerous
• breach of probation x 4 counts
Jonathan Carriere:
• break and enter, commit indictable offence
• assault with a weapon
• weapons dangerous
• breach of probation x 3 counts
• breach of undertaking x 2 counts
Jonathan Gauthier :
• break and enter, commit indictable offence
• assault with a weapon
• weapons dangerous
• breach of recognizance
It is alleged on April 19th, 2020 the three men armed with various objects forced their way into a Walton Street residence. Police were contacted and located the men a short distance away. They were taken into custody, charged accordingly and held for a bail hearing.

ASSAULT, MISCHIEF
Cornwall, ON – Lianne Duff, 33 of Cornwall was arrested on April 19th, 2020 and charged with assault and mischief. It is alleged during an argument on April 19th, 2020 the woman struck another woman known to her and damaged her phone. Police were contacted and an investigation ensued. The woman was taken into custody, charged accordingly and held for a bail hearing.

WARRANT
Cornwall, ON – Julie Ladue, 28 of Cornwall was arrested on April 20th, 2020 on the strength of a warrant. It is alleged on several occasions in 2019 the woman failed to sign in with police as per her conditions and a warrant was issued for her arrest. She was located on April 20th, 2020, taken into custody and held for a bail hearing.

There were 139 calls for service in the City of Cornwall in over the weekend (8am Friday to 8am Monday morning).

APRIL 28, 2020

WARRANT 

            Cornwall, ON – A 16-year-old South Mountain youth was arrested on April 24th, 2020 on the strength of a warrant. It is alleged the youth failed to attend court on February 20th, 2020 for a theft charge and a warrant was issued for his arrest. He was taken into custody on April 24th, 2020 and released to appear in court at a later date. His name was not released as per provision of the Youth Criminal Justice Act.

THEFT UNDER, RESIST ARREST, OBSTRUCT POLICE, FORCIBLE CONFINEMENT 

            Cornwall, ON – Thomas Quinn, 38 of Cornwall was arrested on April 24th, 2020 and charged with theft under $5000, obstruct police, resist arrest and forcible confinement. It is alleged on April 24th, 2020 the man removed merchandise from a Marlborough Street store making no attempt to pay for the merchandise as he left the store. Police were contacted and located the man a short distance away. He refused to co-operate with police and was taken into custody after a brief struggle. It is also alleged on April 26th, 2020 the man purposely locked two persons in a laundry room and police were contacted to investigate. He was taken into custody during the investigation, charged accordingly and released to appear in court on July 9th, 2020.

THREATS, BREAK AND ENTER, MISCHIEF, BREACH 

            Cornwall, ON – A 23-year-old Cornwall man was arrested on April 24th, 2020 and charged with threats, break and enter, mischief and breach of recognizance for attending his ex-girlfriend’s residence, communicating with her and for being outside his residence despite a curfew. It is alleged on April 23rd, 2020 the man entered his ex-girlfriend’s residence without permission and damaged a wall. It is also alleged he threatened to burn down a house and he damaged a car. Police were contacted and an investigation ensued. He was taken into custody, charged accordingly and held for a bail hearing. His name was not released as it would identify the victim in the matter. 

THEFT UNDER 

            Cornwall, ON – Jonathan Lauzon, 33 of Cornwall was arrested on April 25th, 2020 and charged with theft under $5000. It is alleged on April 25th, 2020 the man removed merchandise from a Second Street store making no attempt to pay for the merchandise as he left the store. Police were contacted and located the man a short distance away. He was taken into custody, charged accordingly and released to appear in court on July 9th, 2020.

WARRANT 

            Cornwall, ON – Katlen Moore, 28 of Cornwall was arrested on April 25th, 2020 on the strength of a warrant. It is alleged the woman failed to attend court on February 28th, 2020 for a public mischief charge and a warrant was issued for her arrest. On April 25th, 2020 the woman attended police headquarters to deal with the matter. She was taken into custody on the strength of the warrant and released to appear in court on July 9th, 2020. 

BREACH 

            Cornwall, ON – A 26-year-old Cornwall man was arrested on April 25th, 2020 and charged with breach of probation for communicating with someone he has conditions not to communicate with, attending her residence and for failing to keep the peace. It is alleged while investigating an unrelated matter on April 25th, 2020 police found the man to be in breach of his conditions. He was taken into custody, charged accordingly and released to appear in court on July 9th, 2020. His name was not released as the conditions stem from a domestic matter and would identify the victim. 

ASSAULT 

            Cornwall, ON – A 38-year-old Cornwall man was arrested on April 25th, 2020 and charged with assault. It is alleged on April 25th, 2020 the man assaulted his 14-year-old son and police were contacted to investigate. He was taken into custody during the investigation, charged accordingly and released to appear in court on July 14th, 2020. His name was not released as it would identify the victim in the matter. 

ASSAULT, THREATS 

            Cornwall, ON – Dustin Dillabough, 28 of Cornwall was arrested on April 26th, 2020 and charged with assault and threats. It is alleged during an argument on April 26th, 2020 the man assaulted and threatened a man known to him. Police were contacted and an investigation ensued. During the investigation he was taken into custody, charged accordingly and released to appear in court on July 9th, 2020. 

There were 151 calls for service in the City of Cornwall in over the weekend (8am Friday to 8am Monday morning).

BREACH

Cornwall, ON – Symphony Pierce, 26 of Williamsburg was arrested on April 23rd, 2020, and charged with breach of a release order for being outside her residence. It is alleged on April 23rd, 2020 the woman was found to be in breach of her release order during a traffic stop. She was taken into custody, charged accordingly and held for a bail hearing.

Cornwall, ON – A 20-year-old Cornwall man was arrested on April 23rd, 2020 and charged with breach of undertaking for communicating with his ex-common-law wife, attending her residence and for being in the company of one of the children. It is alleged on April 23rd, 2020 police attended a residence for a disturbance and found the man in breach of his conditions. He was taken into custody, charged accordingly and released to appear in court on July 7th, 2020. His name was not released as the conditions stem from a domestic incident and would identify the victim in the matter.

Cornwall, ON – A 32-year-old Cornwall woman was arrested on April 24th, 2020 and charged with breach of recognizance for communicating with her ex-common-law husband, attending his residence and for being where he might be. She was also charged with breach of a probation order. It is alleged on April 18th, 2020 police attended the area of McConnell and Eleventh Street for a disturbance and an investigation ensued. During the investigation police found the woman to be in breach of her conditions. She was taken into custody on April 24th, 2020 charged accordingly and released to appear in court on July 7th, 2020. Her name was not released as the conditions stem from a domestic incident and would identify the victim in the matter.

DRUG WARRANTS RESULT IN SIX ARRESTS AND THE SEIZURE OF OVER $40,000 IN DRUGS AND CURRENCY

Cornwall, ON – On the morning of May 1st, 2020, members of the Cornwall Police Service (CPS) Street Crime Unit, the Cornwall Emergency Response Team, and the Ontario Provincial Police Tactics and Rescue Unit, executed two drug warrants simultaneously at a Third Street residence and a Pitt Street residence.

During the search, police located a quantity of fentanyl, cocaine, crack cocaine, hydromorphone, illicit cannabis, as well as a quantity of Canadian currency. The combined street value of the drugs and currency is estimated to be over $40,000.00.
As a result of the investigation, six individuals were taken into custody and charged with the following:

Peter Blake, 29, of Cornwall:
• Possession of a Schedule I substance for the purpose of trafficking – cocaine
• Possession of a Schedule I substance for the purpose of trafficking – fentanyl
• Possession of illicit cannabis
• Possession of property obtained by crime over $5000
• Conspiracy to commit an indictable offence
• Failure to comply with release order x 2 (for failing to reside at an approved residence and possessing a cell phone)

Jean-Marc Guindon, 23, of Cornwall:
• Possession of a Schedule I substance for the purpose of trafficking – cocaine
• Possession of a Schedule I substance for the purpose of trafficking – fentanyl
• Possession of illicit cannabis
• Possession of property obtained by crime over $5000
• Conspiracy to commit an indictable offence

Anthony Logan, 30, of Cornwall:
• Possession of a Schedule I substance for the purpose of trafficking – cocaine
• Possession of a Schedule I substance for the purpose of trafficking – fentanyl
• Possession of illicit cannabis
• Possession of property obtained by crime over $5000
• Conspiracy to commit an indictable offence
• Breach of probation x 2 (for failing to notify a change of address and failing to keep the peace)

William Brown, 36, of Cornwall:
• Possession of a Schedule I substance for the purpose of trafficking – cocaine
• Possession of a Schedule I substance for the purpose of trafficking – hydromorphone
• Conspiracy to commit an indictable offence

Natasha Lalonde, 35, of Cornwall:
• Possession of a Schedule I substance for the purpose of trafficking – cocaine
• Possession of a Schedule I substance for the purpose of trafficking – hydromorphone
• Conspiracy to commit an indictable offence

Samantha MacIntyre, 30, of Cornwall:
• Possession of a Schedule I substance – cocaine

All of the individuals were held in custody to await a bail hearing, with the exception of Samantha MacIntyre, who was released to appear in court on July 23rd, 2020.

WARRANT

Cornwall, ON – A 52-year-old Cornwall man was arrested on May 1st, 2020 on the strength of a warrant. It is alleged during the month of March, 2020 the man communicated with his ex-girlfriend despite his conditions and a warrant was issued for his arrest. He was located on May 1st, 2020, taken into custody on the strength of the warrant and held for a bail hearing. His name was not released as the conditions stem from a domestic incident and would identify the victim.

MISCHIEF, POSSESSION OF A CONTROLLED SUBSTANCE

Cornwall, ON – A 35-year-old Cornwall man was arrested on May 1st, 2020 and charged with mischief under $5000 and possession of a controlled substance. It is alleged on May 1st, 2020 the man damaged his girlfriend’s door and police were contacted to investigate. He was taken into custody during the investigation and found to be in possession of a controlled substance. He was charged accordingly and held for a bail hearing. His name was not released as it would identify the victim in the matter.

ASSAULT WITH A WEAPON, MISCHIEF

Cornwall, ON – A 29-year-old North Lancaster woman was arrested on May 2nd, 2020 and charged with assault with a weapon and mischief. It is alleged during an argument on May 2nd, 2020 the woman threatened her common-law husband with a bat and damaged a door. Police were contacted and an investigation ensued. She was taken into custody during the investigation, charged accordingly and released to appear in court on July 21st, 2020. Her name was not released as it would identify the victim in the matter.

THREATS

Cornwall, ON – Stephen Donnelly, 20 of Cornwall was arrested on May 2nd, 2020 and charged with threats. It is alleged on May 2nd, 2020 the man threatened to shoot several people known to him and police were contacted to investigate. The man was taken into custody during the investigation, charged accordingly and held for a bail hearing.
IMPAIRED, OVER 80

Cornwall, ON – Jacob Gagnon, 21 of Cornwall was arrested on May 3rd, 2020 and charged with impaired operation of a motor vehicle and over 80. It is alleged in the early morning hours of May 3rd, 2020 the man was operating a motor vehicle while under the influence of alcohol in the area of Seventh Street and York Street. He was taken into custody during a traffic stop, charged accordingly and released to appear in court on July 14th, 2020.

WARRANT

Cornwall, ON – Mathew Brown, 31 of Cornwall was arrested on May 3rd, 2020 and on the strength of a warrant. It is alleged the man failed to attend court on January 20th, 2020 for a fraud charge and a warrant was issued for his arrest. The man was located on May 3rd, 2020, taken into custody, charged accordingly and held for a bail hearing.

BREACH

Cornwall, ON – A 39-year-old Cornwall man was arrested on May 3rd, 2020 and charged with breach of a judicial release order as well as a probation order for communicating with someone he has conditions not to associate with and for being with that person. It is alleged on May 3rd, 2020 police attended a McConnell Avenue residence for a disturbance and found the man in breach of his conditions. He was taken into custody, charged accordingly and held for a bail hearing. His name was not released as the conditions stem from a domestic incident and would identify the victim in the matter.

MISCHIEF, THEFT OF MAIL, BREACH

Cornwall, ON – Joshua Deevy, 36 of Cornwall was arrested on May 4th, 2020 and charged with mischief under $5000 and theft of mail. He was also charged with breach of release order for having a weapon in his possession. It is alleged on April 4th, 2020 police attended a Kirkman Court address for a mischief complaint and once on scene found the man had broken some of the homeowner’s property with a metal pipe. He was taken into custody and was in possession of someone else’s mail. He was charged accordingly and held for a bail hearing.

ASSAULT, BREACH 

            Cornwall, ON – A 17-year-old Cornwall youth was arrested on April 30th, 2020 and charged with assault and breach of a release order for associating with someone he has conditions not to associate with. It is alleged on April 29th, 2020 the youth assaulted another youth known to him and police were contacted to investigate. The youth was located on April 30th, 2020, taken into custody, charged accordingly and held for a bail hearing. His name was not released as per provision of the Youth Criminal Justice Act.

BREACH 

            Cornwall, ON – On April 30th, 2020 police attended a Kirkman court address for a disturbance call and found the following persons in breach of their conditions: 

Luc Cayen, 51 of Cornwall was taken into custody and charged with breach of recognizance for communicating with someone he has conditions not to communicate with. He was released to appear in court on July 30th, 2020. 

Taylor Barkhouse, 28 of Cornwall was taken into custody and charged with breach of recognizance for communicating with someone she has conditions not to communicate with and for failing to keep the peace. She was released to appear in court on July 28th, 2020. 

Trevor Wililams, 31 was taken into custody for breaching a conditional sentence order for being outside his residence. He was held for a bail hearing.

THEFT UNDER $5000

Cornwall, ON – Richard Zeran, 51 and Judith Delorme, 53 both of Cornwall were arrested on May 5th, 2020 and charged with theft under $5000. It is alleged on April 21st, 2020 they attended a Ninth Street store and removed property making no attempt to pay for the items as they left the store. Police were contacted and an investigation ensued. On May 5th, 2020 they both attended police headquarters to deal with the matter. They were taken into custody, charged accordingly and released to appear in court on July 28th, 2020.

WARRANT

Cornwall, ON – Kanekiiostha Edwards, 44 of Cornwall was arrested on May 5th, 2020 on the strength of a warrant. It is alleged the woman failed to attend court on January 9th, 2020 for threats and weapons charges and a warrant was issued for her arrest. On May 5th, 2020 the woman was located at the Cornwall Courthouse, taken into custody on the strength of the warrant and released to appear in court on July 28th, 2020.

Cornwall, ON – A 34-year-old Cornwall man was arrested on May 5th, 2020 and charged with assault and breach of a release order and probation order for communicating with his ex-girlfriend, attending her residence and for failing to keep the peace. It is alleged during an argument on May 5th, 2020 the man assaulted his ex-girlfriend and police were contacted to investigate. The man was taken into custody during the investigation, charged accordingly and held for a bail hearing. His name was not released as it would identify the victim in the matter.

Cornwall, ON – A 37-year-old Cornwall man was arrested on May 5th, 2020 and charged with criminal harassment. DRUG WARRANT
Cornwall, ON – As a result of a drug warrant that was executed on May 1st, 2020, James Stevenson, 52 of Cornwall was arrested on May 6th, 2020 and charged accordingly.
RECAP

Off-duty officer charged with Impaired driving-related offence

(Ottawa) — An off-duty Ottawa Police Service member has been charged with Impaired driving on Monday, May 4th. Police responded to calls from the public about an erratic driver in the area of Old Montreal Road and Dairy Road, at approximately 1:45pm.

Constable James Monroe, 50 years old, of Ottawa was charged by the Ottawa Police with Operating a conveyance with a Blood Alcohol Content of /over 80 mg of alcohol in 100 ml of blood contrary to section 320.14(1)(b) the Criminal Code of Canada.

The officer was released on a Promise to Appear.

He has been assigned to administrative duties.

The Ottawa Police Service Professional Standards Section has begun an investigation into this matter.

It is alleged between 2018 and 2020 the man assaulted his common-law wife, sexually assaulted her, prevented her from leaving the residence and threatened to damage her mother’s car. It is also alleged he damaged the walls in the residence, injured the cats and was abusive towards the dogs. Police were contacted and an investigation ensued. On May 11th, 2020 the man attended police headquarters to deal with the matter. He was taken into custody, charged accordingly and released to appear in court at a later date. Cornwall, ON- A 48-year-old Cornwall man was arrested on May 11th, 2020 and charged with two counts of assault and threats. It is alleged during an argument on May 11th, 2020 the man assaulted his common-law wife and assaulted and threatened another man who attempted to intervene. Police were contacted and an investigation ensued. He was taken into custody during the investigation, charged accordingly and released to appear in court on July 21st, 2020. (SOUTH STORMONT, ON) – Members of the SD&G Ontario Provincial Police (OPP) Crime Unit assisted by the OPP Digital Forensic Unit , Child Sexual Exploitation Unit of the Royal Canadian Mounted Police at the National Child Exploitation Coordination Centre (NCECC), The National Centre for Missing and Exploited Children (NCMEC) and the Cornwall Police Service conducted a child pornography investigation.

On May 12, 2020 SD&G Crime Unit members arrested and charged Kevin DOCKERY, age 51 years, of South Stormont Ontario under the Criminal Code (CC) with;

–             Access any Child Pornography – sec. 163.1(4.1)

–             Did unlawfully Make Available Child Pornography – computerized graphic files – sec, 163.1(3) – two counts

–             Did have in his Possession Child Pornography – computerized Graphic files – sec. CC 163.1(4)

The accused was held for a bail hearing on May 13, 2020 at the Ontario Court of Justice in Cornwall.

Are you shocked? Career criminal and allegedly bad short order cook Kevin Dockery was busted by SD&G OPP for Kiddie Porn. Mr. Dockery gained fame locally for leading a two hate groups (the first was taken down for anti semitic comments) and two boycott groups against this scribbler and this newspaper.

The local police refused to lay charges against him at the time, this including the Cornwall Police, the OPP at the time, and even the RCMP when he violated copyright not once, but twice of the same video, having it loaded to you tube and facebook.

He is not the first member of that group to end up on the police blotter.

Mr. Dockery was also championed by former Liberal MPP and failed mayoralty candidate and expert grocery cart wiper, David Murphy.

You seem to be on target, referring to this product as more of a personal blog. From what you described to me, that’s exactly what it is.

Sounds like the person who operates this has very little or no journalistic training or understanding of the community service aspect of a news organization. Also sounds like his understanding of ethical guidelines or acceptable journalistic practices is weak at best. His product is not a member of the Ontario Press Council and is therefore not subject to our guidelines, considerations or rulings.

The most effective way to deal with him is to avoid reading what he posts on line because he uses the visits to sell advertising. A second approach would be to start a boycott of any advertisers he has attracted and make sure any advertisers know that there is a boycott and, from what you have shared with me, it should grow. Also take your concerns to other media serving the community so that the word spreads. But be prepared to feel his counter attack.

If it gets personal and his rants use untrue statements and unfounded facts, make sure you get a lawyer to send him a letter threatening him with legal libel action.

You might ask others who feel unjustly targeted to share the costs of hiring a lawyer.

Cornwall, ON- A 15-year-old Long Sault youth was arrested on May 21st, 2020 and charged with break and enter, as well as five counts of breach of youth probation for failing to keep the peace, failing to abide by a curfew, and possessing weapons. It is alleged during the early morning hours on May 21st, 2020, the youth attended the Marina 200, entered a boat that did not belong to him, and removed property. Police were contacted and took the youth into custody, at which time he was found to be in possession of two edged objects. He was charged accordingly and released to appear in court at a later date. His name was not released as per provision of the Youth Criminal Justice Act.

BREACH

Cornwall, ON – A 19-year-old Cornwall man was arrested on May 21st, 2020 and charged with breach of undertaking for failing to abide by a curfew. He was also charged with breach of youth probation for failing to keep the peace. It is alleged on April 9th, 2020, while police were investigating an unrelated matter, the man was not present at his residence, despite his curfew, and an investigation ensued. On May 21st, 2020, the man attended police headquarters to deal with the matter. He was taken into custody, charged accordingly and released to appear in court at a later date. His name was not released as his conditions stem from when the man was a youth and is protected under the Youth Criminal Justice Act.

OPERATION WHILE PROHIBITED, IMPAIRED, BREACH

Cornwall, ON – Joshua Tilley, 27, of Cornwall was arrested on May 21st, 2020 and charged with three counts of operation while prohibited, impaired operation of a motor vehicle, and breach of probation for failing to keep the peace. It is alleged on May 21st, 2020, the man was operating a motor vehicle while prohibited from doing so, and while impaired by drugs. He was taken into custody during a traffic stop, charged accordingly and released to appear in court on August 11th, 2020.

Cornwall, ON – Leanne Duff, 33, of Cornwall was arrested on May 21st, 2020 and charged with the following:

• Obstruct justice x 2
It is alleged on May 21st, 2020, during an altercation with two people known to her, the woman assaulted one of the individuals with a glass object and made threats to harm the other individual. It is further alleged on two occasions, the woman attempted to obstruct an unrelated, ongoing investigation. Police attended and took the woman into custody. She was charged accordingly and held for a bail hearing.

Cornwall, ON – A 26-year-old Cornwall man was arrested on May 21st, 2020 and charged with four counts of breach of probation for contacting his girlfriend and being within a certain distance of her, failing to notify a change of address, and failing to keep the peace. He was also charged with breach of undertaking for contacting and being within a certain distance of his girlfriend and failing to notify a change of address. It is alleged on May 21st, 2020, police were called to a disturbance and located the man in the company of his girlfriend, despite his conditions. During the investigation, he was taken into custody, charged accordingly and held for a bail hearing. His name was not released as it would identify the victim in the matter.

Cornwall, ON – David Schulte, 30, of Cornwall was arrested on May 21st, 2020 and charged with arson and breach of probation for failing to keep the peace. It is alleged on May 21st, 2020, the man was responsible for causing a fire to a building in the area of Montreal Road and Boundary Road. Police were contacted and an investigation ensued. During the investigation, he was taken into custody, charged accordingly, and released to appear in court on July 28th, 2020.

DRUG WARRANT

Cornwall, ON – Dylan Jarvis, 25 of Cornwall was arrested on May 20th, 2020 and charged with the following:

• Possession of cocaine
• Possession of property obtained by crime
• Flight from police
• Dangerous operation of a motor vehicle
• Drive while prohibited
• Breach of probation for being in possession of drugs and failing to keep the peace

On May 20th, 2020 members of the Cornwall Police Service’s Street Crime Unit assisted by the Emergency Response Team executed a warrant at an Albert Street residence. During this time police attempted to stop Jarvis who drove a vehicle in a dangerous manner. He was taken into custody moments later, charged accordingly and held for a bail hearing. As a result of the warrant a quantity of cocaine, Canadian currency and vehicles were seized by police.

CHILD ABANDONING

Cornwall, ON – On the morning of May 19, 2020, police were contacted concerning the wellbeing of two young children in the area of Fourth Street West and Bedford Street. An investigation ensued, resulting in a 22-year-old woman and 24-year-old man subsequently being taken into custody and charged with abandoning a child. They were both released from police custody to appear in court on August 25th, 2020. Their names were not released in order to protect the identity of the involved children.

MISCHIEF, BREACH

Cornwall, ON – Harley Dumais, 18 and a 17-year-old youth both from Cornwall were arrested on May 19th, 2020 and charged with mischief. Dumais was also charged with breach of undertaking for attending the Cornwall Square. It is alleged on May 19th, 20920 the two damaged a pickup truck at the Cornwall Square and police were contacted to investigate. Both were located in the area, taken into custody, charged accordingly and released to appear in court at a later date. The 17-year-old’s name was not released as per provision of the Youth Criminal Justice Act.

MISCHIEF

Cornwall, ON – Four youths ages between 14-16 have been arrested and charged with 8 counts of mischief. In the early morning hours of May 8th, 2020 several vehicles were damaged throughout the city and an investigation ensued. As a result of an ongoing investigation by the Criminal Investigation Divisions, 4 youths were taken into custody, charged accordingly and released to appear in court at a later date. Their names were not released as per provision of the Youth Criminal Justice Act.

Cornwall, ON – Gail Walker, 63 of Cornwall was arrested on May 15th, 2020 and charged with theft under $5000, dangerous driving and assault with a weapon. It is alleged on May 5th, 2020 the woman attended a Second Street East store removed merchandise making no attempt to pay for the item as she left the store. The Loss Prevention officer attempted to stop her at which point she drove her motor vehicle in a dangerous manner in his direction. Police were contacted and an investigation ensued. On May 15th, 2020 the woman was taken into custody, charged accordingly and released to appear in court on July 30th, 2020.

Cornwall, ON – A 37-year-old Cornwall man was arrested on May 15th, 2020 and charged with breach of a release order for being outside his residence and for communicating with someone he has conditions not to communicate with. It’s alleged the man was found to be in breach of his conditions when police were investigating an unrelated matter on May 14th, 2020. On May 15th, 2020 the man was taken into custody, charged accordingly and held for a bail hearing. Cornwall, ON – Kevin Monette, 33 of Cornwall was arrested on May 15th, 2020 and charged with impaired operation of a motor vehicle and over 80. It is alleged on May 15th, 2020 the man was operating a motor vehicle while under the influence of alcohol in the area of Brookdale Avenue. He was taken into custody during a traffic stop, charged accordingly and released to appear in court on August 11th, 2020.

POINTING A FIREARM, POSSESSION OF A WEAPON FOR A DANGEROUS PURPOSE, UNAUTHORISED POSSESSION OF A FIREARM, ASSAULT WITH A WEAPON, THREATS

Cornwall, ON – Trent Boudrias, 21 of Cornwall was arrested on May 15th, 2020 and charged with the following:
• Pointing a firearm
• Possession of a weapon for a dangerous purpose
• Unauthorized possession of a firearm
• Unauthorized possession of a firearm in a motor vehicle
• Assault with a weapon
• Uttering threats to cause death
It is alleged on May 8th, 2020 the man pointed a firearm at another man known to him and police were contacted to investigate. On May 15th, 2020 the man was taken into custody, charged accordingly and released to appear in court on July 28th, 2020.

BREAK AND ENTER, ASSAULT, ASSAULT WITH A WEAPON, THREATS, ROBBERY
Cornwall, ON – Trevor Williams, 31 of Cornwall was arrested on May 15th, 2020 and charged with the following:
• Break and Enter
• Assault
• Assault with a weapon
• Uttering threats
• Robbery
It is alleged on May 15th, 2020 the man forced his way into another man’s apartment and assaulted him. It’s also alleged he struck the man on the head with and object, removed some of his property and threatened to harm him at a later time. Police were contacted and an investigation ensued. The man was taken into custody during the investigation, charged accordingly and held for a bail hearing.
ASSAULT
Cornwall, ON – A 23-year-old Cornwall woman was arrested on May 16th, 2020 and charged with assault. It is alleged during an argument on May 16th, 2020 the woman struck her husband and police were contacted to investigate. She was taken into custody, charged accordingly and released to appear in court on July 21st, 2020. Her name was not released as it would identify the victim in the matter.

WARRANT
Cornwall, ON – Rachelle Seguin, 31 of Cornwall was arrested on May 16th, 2020 on the strength of a warrant. It is alleged the woman failed to attend court on September 23rd, 2019 for an impaired operation charge and a warrant was issued for her arrest. On May 16th, 2020, the woman was located by police, taken into custody on the strength of the warrant and held for a bail hearing.

Cornwall, ON – Shari Gagnon, 52 of Cornwall was arrested on May 16th, 2020 on the strength of a warrant. It is alleged the woman failed to sign in with police in February, 2020 as per her conditions and a warrant was issued for her arrest. On May 16th, 2020, the woman was located by police, taken into custody on the strength of the warrant and held for a bail hearing.

Cornwall, ON – Megan Locker, 29 of Ottawa was arrested on May 18th, 2020 on the strength of a warrant. It is alleged in early 2015 the woman deposited two fraudulent cheques. Police were contacted and a warrant was issued for her arrest. On May 18th, 2020 a member of the Cornwall Police Service attended Ottawa as Ottawa Police Service had the woman in custody on the strength of Cornwall’s warrant. She was transported to Cornwall and released to appear in court on August 11th, 2020.

DRIVE WHILE PROHIBITED
Cornwall, ON – Devon Johnson, 21 of Akwesasne was arrested on May 18th, 2020 and charged with drive while prohibited. It is alleged the man was driving a motor vehicle on May 18th, 2020 in the area of First Street and Prince Arthur. He was taken into custody during a traffic stop, charged accordingly and released to appear in court on August 27th, 2020.

HARASSING COMMUNICATIONS
Cornwall, ON – A 31-year-old Cornwall man was arrested on May 18th, 2020 and charged with harassing communications. It is alleged during the month of May, 2020 the man repeatedly communicated with his ex-common-law wife and police were contacted to investigate. He was taken into custody on May 18th, 2020, charged accordingly and released to appear in court on August 18th, 2020. His name was not released as it would identify the victim in the matter.

BREAK AND ENTER, POSSESSION OF BREAK IN TOOLS, CARYING A CONCEALED WEAPON, POSSESSION OF A WEAPON FOR A DANGEROUS PURPOSE
Cornwall, ON – Peter Martin, 18 of Cornwall and a 16-year-old Akwesasne youth were arrested on May 19th, 2020 and charged with attempt break and enter. Peter Martin was also charged with carrying a concealed weapon, possession of a weapon for a dangerous purpose and possession of break in tools. It is alleged in the early morning hours of May 19th, 2020 they attempted to break into a convenience store in the north end of the city and police were contacted to investigate. Both were located a short distance away and Martin was found to be in possession of a BB gun as well as break in tools. They were taken into custody, charged accordingly and released to appear in court at a later date.

There were 205 calls for service in the City of Cornwall in over the long weekend (8am Thursday to 8am Tuesday morning). 




#OPP Part of Biggest Fentanyl Bust in Canadian History 061820

(TORONTO, ON) – Enforcement action has taken place in the Greater Toronto Area (GTA) in relation to the production and trafficking of fentanyl pills. Several individuals have been arrested under the Controlled Drugs and Substances Act (CDSA).

Project JAVELIN began in April 2020 with the investigation into a suspected methamphetamine production operation in Durham and Halton regions. As the investigation proceeded, evidence suggested it was in fact a fentanyl tableting operation. Once production was complete, suspects were then trafficking the fentanyl pills in both Ontario and British Columbia. On May 27, 2020 enforcement action took place in British Columbia which led to the interception of a large quantity of fentanyl pills.

As a result of the enforcement action in British Columbia, similar enforcement took place in Ontario on May 30, 2020 by the Methamphetamine & Synthetic Drug Production Taskforce where three suspects involved in the production facilities were arrested. The following individuals have been arrested and charged with offences under the CDSA:

  • Halid SEFIC, age 30 of Burlington;
  • Edin SEFIC, age 34 of Burlington, and;
  • Richard ATANASOFF, age 56 of Toronto.

The charges associated with the accused can be found on the ADDENDUM OF CHARGED PERSONS.

The suspects were producing fentanyl pills that were counterfeit replicas of legitimate Teva‐Oxycocet 5mg/325mg pills. It is important to note that Teva Canada collaborates with law enforcement agencies and regulatory authorities to identify counterfeit medication and to protect patients by removing dangerous forgeries from our communities.

On May 30, 2020 as a result of evidence gleaned after the arrest of the above individuals, five search warrants were conducted by investigators from the Methamphetamine & Synthetic Drug Production Taskforce which includes the Ontario Provincial Police (OPP), Durham Regional Police Service (DRPS), Peel Regional Police Service (PRPS), Toronto Police Service (TPS) and York Regional Police (YRP). Investigators from Halton Regional Police Service, DRPS Drug Enforcement Unit, the OPP Clandestine Laboratory Investigative Response Team (CLIRT), Organized Crime Enforcement Bureau (OCEB), Urban Search and Rescue and CBRNE Response Team (UCRT), OPP West Region Emergency Response Team (ERT) and OPP Central and West Region Community Street Crime Units (CSCU) assisted with the execution of search warrants. These five search warrants were conducted at suspected fentanyl tableting and storage sites with one location in Oakville and four locations in Burlington.

As a result of the enforcement actions, investigators seized:

  • 123,700 fentanyl pills;
  • 70 kg of fentanyl powder;
  • More than 300 kg of bulk powder utilized as binding/cutting agent;
  • One (1) commercial-sized pill press;
  • One (1) industrial pill press with counterfeit tableting stamp;
  • Three (3) commercial-sized mixers;
  • One (1) pill coating machine;
  • Approximately 700 empty bulk pharmacy-sized pill bottles;
  • One (1) roll of fraudulent “Teva-Oxycocet” labels;
  • One (1) pill bottling tableting table; and
  • $20,000 in CAD currency.

This is the largest seizure of fentanyl by law enforcement in Ontario.

The three accused were arrested and released on Undertakings. They are expected to appear at various Ontario Court of Justice locations in September 2020. 

Indicators of a synthetic drug production site include:

  • Suspicious activity, secretive behavior and avoidance of neighbour interactions;
  • Occupants attend for short time periods and at odd hours;
  • Chemical odours;
  • Garbage contains numerous chemical containers, glassware, bags full of soil or garbage are never put out;
  • Location has excessive security;
  • Evidence of chemical dumping grounds on or near premises;
  • Obstructed or covered windows; and
  • Odd items being brought inside the location – equipment, glassware, chemical drums, etc.

CHARGES LAID – BREAK IN

(NORTH GLENGARRY, ON) – On January 7, 2020 at approximately 1:00 a.m., members of the Stormont, Dundas & Glengarry (SD&G) Detachment of the Ontario Provincial Police (OPP) responded to a break in a residence on County Road 43 in North Glengarry Township.

The investigation has determined that four individuals, wearing disguises, attempted to break into the residence. The suspects had various weapons but were confronted by the home owner and fled in a vehicle.

The victims were not injured.

On January 11, 2020 SD&G OPP Crime Unit arrested and charged Jason DURION (age 46) of Cornwall, Ontario with;

–             Break and enter a place – with intent to commit indictable offence

–             Possession of weapon for dangerous purpose

–             Conspiracy to commit indictable offence

–             Disguise with intent

DURION was held in custody and was scheduled to appear in Cornwall court.

On June 24, 2020 SD&G OPP Crime Unit arrested and charged Stepha FRANKLIN (age 30) of Cornwall, Ontario with;

–             Break and enter a place – with intent to commit indictable offence

–             Conspiracy to commit indictable offence

–             Disguise with intent

–            Fail to comply with conditions of a probation order ( four counts)

Franklin was held in custody and is scheduled to appear in Cornwall court.

RESIST ARREST

(NORTH GLENGARRY,ON) – On June 22, 2020 at approximately 12:36 pm, a Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) officer conducted a traffic stop for a highway traffic act violation on County Road 34 in North Glengarry Township. The officers attempted to de-escalate the situation as the individual became aggressive with the officer. The individual then refused to follow officer’s directions and resisted the officer during the arrest. The individual was found to be in possession of suspected methamphetamine.

Philippe BOURGON (age 40) from North Glengarry, Ontario was arrested and is charged with;

–             Resist Peace Officer

–             Possession of a controlled substance

–             Fail to wear a proper helmet on power-assisted bicycle (Highway Traffic Act)

The accused was released and is scheduled to appear at the Ontario Court of Justice in Alexandria September 2, 2020.

MULTIPLE CHARGES LAID

(SOUTH DUNDAS,ON) – On June 20, 2020 at approximately 8:46 a.m, a Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) officer responded to a single motor vehicle collision on County Road 31, South Dundas Township. The driver if the vehicle fail to remain with the vehicle but was located by officers a short distance away. The driver was found to be in possession of suspected methamphetamine and the vehicle was stolen. Further investigation revealed the driver was also wanted for several other offence including another stolen vehicle incident from the previous weeks in North Dundas Township. (Stole a Township of North Dundas Township pick-up truck, which was recovered following a collision and abandoned.) The driver was aslo breaching previous release conditions.

The driver, Roxanne HANSON (age 21) of North Dundas Township, Ontario was arrested and charged with;

– Possession of a Controlled Substance

– Theft over $5000

– Break and enter

– Possession of property obtained by crime – under $5000

– Take motor vehicle without consent

– Fail to comply with conditions of a probation order ( 20 counts)

– Fail to remain (Highway Traffic Act)

The driver was held in custody and scheduled to appear at the Ontario Court of Justice in Cornwall.

WEAPONS CHARGE LAID

(SOUTH GLENGARRY, ON) – On June 20, 2020 at approximately 1:12 p.m, a Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) officer responded to a weapons call on Concession Road 7, South Glengarry Township. The investigation revealed an adult was target shooting in the area in an unsafe direction.

A 49 year -old male of South Glengarry, Ontario was arrested and charged with;

– Careless use of Firearm, weapon, prohibited device or ammunition.

The accused was released and scheduled to appear at the Ontario Court of Justice in Alexandria on September 2, 2020.

ASSAULT WITH A WEAPON – DOMESTIC

(NORTH GLENGARRY,ON) – On June 20, 2020 at approximately 8:17 p.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of domestic situation in North Glengarry Township. Investigation revealed that an adult accused had assaulted the victim with a weapon.

A 26-year-old accused of Cornwall, Ontario was arrested and is charged with;

– Assault with a weapon  

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Cornwall on August 4, 2020.

IMPAIRED DRIVER

(SOUTH DUNDAS, ON) – On June 20, 2020 at approximately 9:04 p.m, Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) officers responded to a traffic complaint on County Road 2 in South Dundas Township.

Investigation revealed that the adult driver was under the influence of alcohol.

Roland SIMON (age 53) of Ottawa, Ontario was arrested and is charged with;

– Operation while impaired – blood alcohol concentration – plus 80

ASSAULT WITH A WEAPON – DOMESTIC

(NORTH DUNDAS,ON) – On June 21, 2020 at approximately 4:10p.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of domestic situation in North Dundas Township. Investigation revealed that an adult accused had assaulted the victim with a weapon.

A 31-year-old accused of North Dundas, Ontario was arrested and is charged with;

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Cornwall on August 18, 2020.

CHARGES LAID

(NORTH DUNDAS,ON) – As a result of a sexual assault investigation conducted by members of the Stormont Dundas & Glengarry Ontario Provincial Police, a 47year-old resident of Ottawa, Ontario was arrested on June 23, 2020. Investigation indicated the male had sexually assaulted an adult female known to him.

The 47-year old male resident of Ottawa, Ontario faces charges of:

– Sexual Assault

He was released and is scheduled to appear at the Ontario Court of Justice in Morrisburg court on September 1, 2020.

The name of the accused is being withheld in order to protect the identity of the victim.

IMPAIRED DRIVER

(NORTH DUNDAS, ON) – On June 21, 2020 at approximately 9:43 p.m, Stormont, Dundas & Glengarry (SD&G) Ontario Provincial Police (OPP) officers responded to a trespass complaint on Church Road in North Dundas Township.

Investigation revealed that the adult driver was under the influence of alcohol.

Nicholas NYENTAP (age 22) of Russell, Ontario was arrested and is charged with;

UPDATE : OPP RESPOND TO BARRICADED PERSON INCIDENT IN IROQUOIS

One Person Arrested, Charges laid

(IROQUOIS, ON) – The Stormont, Dundas and Glengarry (SD&G) Detachment of the Ontario Provincial Police (OPP) has arrested one person after an overnight incident in Iroquois in the municipality of South Dundas.

On June 22, 2020, at approximately 11:30 p.m., OPP officers responded to a disturbance at a residence on Dundas Street. As a result of the situation, the OPP Tactics and Response Unit (TRU), Emergency Response Team (ERT) Canine (K9) and OPP Crisis Negotiators were called in to assist with this incident.

Officers entered the home early this morning and a 35 year old male was taken into custody without incident. The investigation has revealed that several domestic related incidents had occurred within the home.

The 35 year-old male was arrested and charged with;

–             Overcome resistance by attempting to choke, suffocate or strangle another person

–             Mischief ( 10 counts)

–             Assault cause bodily harm

–             Assault

–             Fail to comply with conditions of a undertaking (two counts)

–             Killing or injuring animals

The accused was held in custody and is scheduled to appear at the Ontario Court of Justice in Cornwall.

FAMILY DISPUTE LEADS TO CHARGES

(NORTH DUNDAS,ON) – On June 24, 2020 at approximately 3:11 p.m Stormont Dundas & Glengarry Ontario Provincial Police officers responded to a report of family dispute in North Dundas Township. Investigation revealed that an adult male had assaulted another adult male at the location with a weapon. The victim was taken to hospital with non-life threatening injuries.

A 23 -year-old of North Dundas, Ontario was arrested and is charged with; 

–             Assault cause bodily harm

–             Assault with a weapon

–            Uttering threats

The accused was released from custody and is scheduled to appear at the Ontario Court of Justice in Morrisburg court on September 1, 2020.

The name of the accused is being withheld in order to protect the identity of the victim.

EXCESSIVE SPEEDS

(SD&G) – On June 20-24, 2020 Ontario Provincial Police officers conducted speed measuring enforcement in SD&G and intercepted the following vehicles for traveling at excessive speeds. The vehicles were impounded and their driver’s permits seized for seven (7) days in accordance to policy and were charged with Stunt Driving (Highway Traffic Act).

– June 20, 2020- 1:49am (South Stormont) vehicle stopped traveling 120km/h (50km/h zone) (Highway 138) – 50-year-old driver from Cornwall, Ontario.

– June 21, 2020- 1:15am (North Dundas) vehicle stopped traveling 111km/h (60km/h zone) (Main Street, Winchester) – 29-year-old driver from North Dundas, Ontario.

– June 22, 2020- 7:08 pm (South Glengarry) vehicle stopped traveling 145km/h (80km/h zone) (County Road 34) – 55-year-old driver from North Glengarry, Ontario.

– June 24, 2020- 9:27 am (North Dundas) vehicle stopped traveling 136km/h (80km/h zone) (County Road 31) – 17-year-old driver from Carlsbad Springs, Ontario.

– June 24, 2020- 12:24pm (South Stormont) vehicle stopped traveling 170km/h (100km/h zone) (Highway 401) – 31-year-old driver from Stratford, Ontario.

Cornwall Police Cleared by SIU in Throat Slitting Incident @ Four Seasons Carwash on Brookdale 063020

The Investigation

Notification of the SIU

On January 7, 2020, at 5:05 a.m., the Cornwall Police Service (CPS) notified the SIU of the Complainant’s injury.
The CPS reported that at 4:30 a.m., CPS officers responded to an address on Brookdale Avenue, Cornwall, for a report of a suicidal male. They saw a male running through backyards and a police officer located the male, the Complainant, at the back of a car wash located on Brookdale Avenue, holding a box cutter knife and threatening to cut his throat. The Complainant cut his throat with the knife and, at some point, a conducted energy weapon (CEW) was deployed. The Complainant was transported by ambulance to the Cornwall Community Hospital (CCH).

On January 7, 2020, three SIU investigators and one forensic investigator were assigned. The SIU arrived on the scene at 9:03 a.m., and immediately began an investigation. Civilian witnesses were identified and interviewed. SIU investigators conducted a canvass of the area where the incident occurred.

The Four Seasons Car Wash at 501 Brookdale Avenue had exterior surveillance cameras on the building. The SIU investigators were provided with raw video footage relevant to this incident. It was later determined that the video footage had captured images of the Complainant at the business, but no video footage was captured of the Complainant’s interaction with the Subject Officer (SO).

The scene was forensically examined and photographed. The involved CEW and a utility knife were seized for evidence. The CEW history was downloaded and reviewed.

On January 7, 2020, the SO was designated as a subject officer. On February 18, 2020, the SO provided a statement and a copy of his notebook entries to the SIU.

The Scene

The Four Seasons Car Wash is a 24-hour self-serve car wash facility. The car wash is located at 501 Brookdale Avenue, Cornwall. [1] The Four Seasons Car wash is located approximately 280 metres from the Complainant’s residence. The interaction between the Complainant and the SO occurred on the east side of the building (behind the car wash) in an open field area.

Forensic Evidence

CEW

An SIU forensic investigator extracted information from the SO’s CEW. The data revealed that the CEW appeared to be in good working order. The records showed one deployment at 4:08 a.m. on January 7, 2020 for a charge duration of five seconds.

Video/Audio/Photographic Evidence

Closed-Circuit Television (CCTV) from Four Seasons Car Wash

The CCTV camera was mounted on the south side of the building, facing west, where it captured images of Brookdale Avenue and the south end of the car wash (vacuum area and parking lot located at the southwest corner of building). The video footage was low resolution quality; however, it did capture images of the Complainant on the west side of the building. There were no CCTV cameras mounted on the east side (back of the building) where the incident occurred.

At 4:01:47 a.m., video images captured the Complainant walking northbound on the east side of Brookdale Avenue along the sidewalk towards the direction of the car wash. A vehicle, a Honda, believed to be the Complainant’s father’s, was captured stopping at a bus lane south of the business. Shortly after, an ambulance was captured entering the view of the camera and stopping behind the Honda.

At 4:02:41 a.m., video images showed the Complainant walking from the sidewalk area of Brookdale Avenue, travelling westbound through a path at the south end of the car wash. The footage showed the Complainant stopping at an electrical box south of the parking lot area of the car wash. The Complainant’s father is seen exiting his vehicle and standing on the sidewalk beside the passenger side of his vehicle looking in an easterly direction. Video footage captured the Complainant pacing near the hydro box. Spotlights from the ambulance are illuminated and pointed in the location of the Complainant. Shortly after, the spotlight was turned off and images captured a paramedic walking near the passenger side of the ambulance. Soon after, a CPS marked police vehicle parked behind the ambulance.

At 4:06:42 a.m., video images showed the Complainant turning to walk eastbound from the area of the hydro box and then moving out of view of the camera.

The remainder of the video footage did not offer any further evidentiary value as the interaction between the Complainant and the SO transpired in a field situated behind the building on the east side where there were no CCTV cameras.

At 3:55 a.m., dispatch advises of call regarding the Complainant and the fact that he has taken a lot of pills.

At 4:03 a.m., dispatch advises that the Complainant was last seen running north behind the house.

At 4:03 a.m., dispatch advises that an ambulance was on scene.

At 4:05 a.m., dispatch advises that the ambulance was in front of the car wash.

At 4:08 a.m., dispatch advises that a CEW has been deployed.

At 4:09 a.m., dispatch advises that the Complainant has cut his neck with a box cutter knife.

At 4:20 a.m., dispatch advises that the Complainant was still being worked on to stabilize his condition before transport away from scene.

At 4:21 a.m., dispatch advises that the Complainant has been taken from the scene.

Upon request the SIU obtained and reviewed the following materials and documents from the CPS:

The SIU also obtained and reviewed CCTV footage from surveillance cameras of a business establishment.

Incident Narrative

The facts in question are not in dispute and may be summarized in short order. Just before 4:00 a.m. of January 7, 2020, the Complainant fled his home in despair having ingested a large quantity of medication. Concerned for his safety, CW #2 called 911 and paramedics and police were dispatched.

The SO was the first officer on scene. At the sight of the officer, the Complainant moved further eastward into a field behind a car wash on Brookdale Avenue followed at a distance by the SO. Shortly thereafter, the Complainant pulled a knife out of his pocket, prompting the officer to draw his CEW. The Complainant placed the knife to the left side of his neck and cut himself severely. At about the same time, the SO discharged his CEW at the Complainant, but the deployment had no effect.

The Complainant fell from his wound and was quickly approached by the SO, who applied pressure to the cut to stem the bleeding. Paramedics took over the Complainant’s care and took him to hospital.

Relevant Legislation

Section 25(1), Criminal Code — Protection of persons acting under authority

25 (1) Every one who is required or authorized by law to do anything in the administration or enforcement of the law(a) as a private person,(b) as a peace officer or public officer,(c) in aid of a peace officer or public officer, or(d) by virtue of his office,is, if he acts on reasonable grounds, justified in doing what he is required or authorized to do and in using as much force as is necessary for that purpose.

Analysis and Director’s Decision

In the early morning hours of January 7, 2020, the Complainant, in the throes of a mental health crisis, cut his throat with a knife causing serious injury. Present at the time of the incident was the SO, who had discharged his CEW at the direction of the Complainant at about the same time that he was self-harming. On my assessment of the evidence, there are no grounds to believe that the SO committed a criminal offence in connection with the Complainant’s injury.

Pursuant to section 25(1) of the Criminal Code, police officers are immune from criminal liability for force used in the course of their duties provided such force was reasonably necessary in the execution of an act that they were required or authorized to do by law. A police officer’s foremost duty is the preservation and protection of life. The SO was clearly engaged in his duty when he responded to the scene attempting to render assistance to the Complainant, who had just been reported as suicidal. In the brief moments the officer was involved with the Complainant, he did what he could to prevent the Complainant doing harm to himself, following him into a darkened field and discharging his CEW at the first sight of a knife in his hands. While the CEW did not have its intended effect of immobilizing the Complainant, the SO can hardly be blamed for that. As soon as the Complainant collapsed from his self-inflicted wound, the SO approached without hesitation to render emergency care. Together with the paramedics on scene, the officer shares in the credit for having saved the Complainant’s life.

On the aforementioned-record, it is apparent that the SO was at all times engaged in the lawful execution of his duty and that he used reasonable force in an effort to bring the situation to a safe and peaceful resolution. Accordingly, there is no basis for criminal charges in this case, and the file is closed.

NURSE CHARGED FOR UNAUTHORIZED USE OF HEALTH INFORMATION

(BELLEVILLE, ON) – Ontario Provincial Police (OPP) Health Fraud Investigation Unit has charged a Belleville Ontario former nurse following an investigation into unauthorized use of personal health information.

Members of the Health Fraud Investigation Unit believe that a hospital nurse in the Belleville area accessed personal health information unlawfully while on duty over a six month period in 2018. This was first uncovered by the nurse’s employer who conducted an audit of apparent breaches under the Personal Health Information Protection Act and ultimately the OPP Health Fraud Investigation Unit was called to investigate.

Police have charged Kimberley Ann Hokkanen, age 59, of Centre Hastings, with 69 counts of Use personal health information, contrary to section 72(1)(a) of the Personal Health Information Protection Act (PHIPA). The offences allegedly took place between February 17, 2018 and September 12, 2018.

The defendant has been summoned to appear at the Ontario Court of Justice in Belleville on September 3, 2020.

Cornwall Police stated to CFN that the report has been made and that no charge has been laid yet.

Ontario recently updated it’s PAWS laws dealing with animal abuse. Penalties can lead to jail and/or fines.

When Mr. Lalonde confronted the driver and his female passenger he was allegedly threatened. The vehicle was Ontario AX 8572

Ottawa Police Cleared by SIU After Cruiser Used to Take Down Knife Wielder JULY 21, 2020

The Investigation

Notification of the SIU

On February 26, 2020 at 8:33 a.m., the Ottawa Police Service (OPS) reported an injury suffered by the Complainant. According to the OPS, on February 25, 2020 at 8:40 p.m., OPS officers were dispatched to a domestic incident involving a male chasing a female with a knife on Trenton Avenue, Ottawa. When police officers arrived at Trenton Avenue, the male attempted to stab them with a knife. The officers utilized their police vehicles to pin the male into a snowbank and took him into police custody. The male was later identified as the Complainant. The Complainant was transported by ambulance to the Ottawa Civic Hospital for medical treatment and was later diagnosed with having a fractured rib, chipped vertebrae and an internal stomach injury.

At the time the incident was reported, the OPS indicated that Ottawa was expecting a snow storm. Accordingly, arrangements were made for OPS to take photographs of the scene and secure the scene.

Evidence

The Scene

The incident took place on the roadway in front of a residential address on Trenton Avenue, Ottawa. The address has a narrow private driveway that runs southbound, which allows access to the back properties of townhouses on Trenton Avenue. Trenton Avenue is a two-way roadway that runs westbound and eastbound. The SO’s police vehicle, a marked OPS SUV, was parked facing eastbound on Trenton Avenue blocking the laneway that enters the Trenton Avenue townhouse complex.

The front passenger side of the SO’s vehicle was against a large snowbank with the passenger door partially open, and a knife with an approximately 30-centimetre blade was found on the front passenger seat. WO #1’s police vehicle was parked in the private laneway, facing southbound. There was a second knife with an approximately 20-centimetre blade located on the ground next to the driver side of a white Kia Soul parked in the south parking lot of the townhouse complex.

The SO’s police vehicle was forensically examined by SIU FI and no frontal collision damage was found.

Forensic Evidence

The Global Positioning Satellite (GPS) Data from the SO’s Police Vehicle

The GPS data collected from the SO’s police vehicle were reviewed.

The SO travelled down Parkdale Avenue to the intersection of Parkdale Avenue and Carling Avenue for approximately three kilometres, reaching speeds of 70.7 km/h. The SO turned west to travel on Carling Avenue for a short distance to the intersection of Fisher Avenue where he turned southbound. While on Carling Avenue, for approximately one kilometre, the SO reached speeds of 59.3 km/h. The SO travelled southbound on Fisher Avenue for approximately three kilometres and reached speeds of 62.1 km/h. At the intersection of Emperor Avenue, the SO turned west and travelled less than a kilometre to the intersection of Hollington Street, reaching speeds of 67 km/h. The SO turned south on Hollington Street and travelled less than two kilometres to the intersection of Trenton Avenue, where he turned east.

The GPS data showed that the SO travelled eastbound on Trenton Avenue for a short distance where he reached speeds of 18 km/h. The recorded speed of 18 km/h is believed to be the speed at which the Complainant was struck by the SO’s police vehicle. [In the SO’s interview, he indicated he was traveling approximately 20 km/h when he struck the Complainant. He reached this speed while travelling less than about nine metres from a stopped position, which was substantiated by the GPS data.]

Video/Audio/Photographic Evidence

The SIU canvassed the area for any video or audio recordings, and photographic evidence, but was not able to locate any.

Police Communications Recordings

At 8:39:39 p.m., information was transmitted that a female (CW #5) was currently safe at a neighbour’s house.

At 8:43:52 p.m., information was transmitted that the Complainant went after his wife and son with a knife.

At 8:48:03 p.m., information was transmitted that the Complainant had two large kitchen knives.

At 8:51:16 p.m., information was transmitted that the Complainant was going toward WO #1 with a knife and that the officer was still in his cruiser.

At 8:52:37 p.m., information was transmitted that the Complainant was down.

At 8:52:47 p.m., information was transmitted that the SO had struck the Complainant with his cruiser.

Upon request the SIU obtained and reviewed the following materials and documents from the OPS:

  • General Occurrence report;
  • OPS Policy Use of Force;
  • OPS Scene Photographs and Scene Diagrams;

  • GPS data from the SO’s police vehicle;
  • Will State-All WOs; and
  • Witness Information List.

In addition to the materials received from the OPS, SIU obtained and reviewed the following materials from other sources:

  • The Complainant’s medical records.

Incident Narrative

The material events in question are relatively clear on the weight of the evidence collected by the SIU, which included interviews with the Complainant, the SO, and several civilian and police eyewitnesses. At about 8:45 p.m. on February 25, 2020, the SO, in the company of his partner, WO #2, arrived at an address on Trenton Avenue. They were there following a call to police reporting that a male – the Complainant – had threatened his daughter with a knife. The officers parked their vehicle curbside facing east just west of the driveway running adjacent to the address – a residential complex – and exited. Shortly after, a cruiser operated by WO #1 reversed out of the driveway such that it was nose-to-nose with the SO and WO #2’s cruiser and facing west on the east side of the driveway. WO #1 shouted a warning to the officers that the Complainant was in the vicinity and armed with a knife.

The Complainant, holding a knife in his right hand with a blade about 30 centimetres in length, approached the driver’s side of WO #1’s cruiser and swung the knife at the officer through the partially open driver’s-side window. WO #1 was not struck and closed his window fully.

Concerned for the safety of WO #1, the SO and WO #2 drew their firearms. The Complainant then turned his attention on the SO and began to move in the SO’s direction with the knife raised in his right hand while shouting that he wanted to be shot. The SO walked backward toward his cruiser and decided against discharging his weapon given the potential for a stray bullet striking third parties in the residential neighbourhood. The SO and WO #2 re-entered their cruiser as the Complainant was about 3.5 metres from the vehicle.

The SO decided to use his vehicle as a weapon. The cruiser accelerated forward, and its front right bumper collided with the Complainant. The impact felled the Complainant and dispossessed him of the knife. WO #1 exited his cruiser and handcuffed the Complainant without further incident.

The Complainant was taken from the scene to hospital, where he was diagnosed with multiple rib fractures.

Relevant Legislation

Section 25, Criminal Code — Protection of persons acting under authority

25 (1) Every one who is required or authorized by law to do anything in the administration or enforcement of the law(a) as a private person,(b) as a peace officer or public officer,(c) in aid of a peace officer or public officer, or(d) by virtue of his office,is, if he acts on reasonable grounds, justified in doing what he is required or authorized to do and in using as much force as is necessary for that purpose.
(3) Subject to subsections (4) and (5), a person is not justified for the purposes of subsection (1) in using force that is intended or is likely to cause death or grievous bodily harm unless the person believes on reasonable grounds that it is necessary for the self-preservation of the person or the preservations of any one under that person’s protection from death or grievous bodily harm.

Section 34, Criminal Code — Defence of person – Use of threat of force

34 (1) A person is not guilty of an offence if(a) They believe on reasonable grounds that force is being used against them or another person or that a threat of force is being made against them or another person; (b) The act that constitutes the offence is committed for the purpose of defending or protecting themselves or the other person from that use or threat of force; and(c) The act committed is reasonable in the circumstances.

Analysis and Director’s Decision

In the evening of February 25, 2020, the Complainant was struck and injured by an OPS cruiser on the roadway outside his residence in Ottawa. The SO, the driver of the cruiser, was identified as the subject officer for purposes of the SIU investigation. On my assessment of the evidence, there are no reasonable grounds to believe that the SO committed a criminal offence in connection with the Complainant’s injuries.

Whether considered pursuant to sections 25(3) or 34 of the Criminal Code, I am satisfied that the force used by the SO was lawful. The former governs the use of force by police officers in the course of their duties that is intended or likely to cause grievous bodily harm or death. [1] Such force will not be justified unless the officer reasonably believed it was necessary to protect him- or herself, or another, from death or grievous bodily harm. The latter regulates the use of force in the defence of oneself or another from a reasonably apprehended attack. It requires that such force be limited to that which is reasonable in all the circumstances, having regard to such considerations as the nature of the force or threat; the use or threatened use of any weapons; and, the nature and proportionality of the person’s response to the use or threat of force.

I begin by noting that the SO was clearly in the lawful execution of his duty at the time of the incident. The officer was aware from the information broadcast on dispatch that he was responding to a violent situation in which the Complainant had threatened his daughter with a knife. Thereafter, the SO personally observed the Complainant attempting to harm WO #1 with the knife before turning to threaten the SO with it. In the circumstances, there were ample grounds for the officers’ presence and the Complainant’s arrest.

While unconventional, I am also satisfied that the SO’s use of the cruiser to strike the Complainant constituted permissible force. By the time the SO adopted the course he did, there was little doubt he believed the Complainant meant to do him harm with the knife given what he knew of the conflict with his daughter and what he had personally observed. While the SO and WO #2, and, indeed, WO #1, may not have been in any imminent danger at the time given the safety of their cruisers, I am satisfied there was an immediate imperative to neutralize the Complainant lest he turn the knife on a third party who may have been present in the area or, given his utterances as he advanced on the SO, himself. In this regard, it is important to note that the SO, having just arrived on the scene, would not have known whether there was anyone in the residential complex who might be at risk. Retreat or delay, in other words, were not realistic options. Finally, while the use of a motor vehicle was inherently dangerous, the SO was aware of the risk and kept his speed down to no more than 18 km/h at the point of impact.

On this record, I am unable to reasonably conclude that the SO’s tactic fell outside the range of what was reasonably necessary to defend against a potentially lethal attack at the hands of the Complainant and to effect his arrest. In arriving at this determination, I am mindful of the common law principle that officers faced with having to make split-second decisions in highly-charged and volatile situations are not expected to measure their force with precision; what is required is a reasonable response, not an exacting one: R v Nasogaluak, [2010] 1 SCR 206; R v Baxter (1975), 27 CCC (2d) 96 (Ont CA) .

In the final analysis, as I am satisfied there are no reasonable grounds to believe that the SO conducted himself other than lawfully in his encounter with the Complainant, there is no basis for proceeding with criminal charges in this case. The file is closed.

  • 1) While I have proceeded on the presumption that the use of a motor vehicle constituted force that was “likely to cause grievous bodily harm or death,” it is arguable that the SO’s use of the cruiser constituted something less than this level of force given the speed at which he struck the Complainant. In any event, as I am of the view that the SO’s use of lethal force, if it be such, was justified, I would also have found the use of the cruiser, ipso facto, lawful force pursuant to section 25(1) of the Code.
